Our current policy reflects the Minnesota Clean Indoor Act which prohibits smoking in all common areas of all apartment buildings in Minnesota. This updated policy goes one step further by prohibiting smoking in the entire building including all the apartments.

No Smoking of any substance or the use of tobacco is prohibited on the entire property including the apartment, all common areas of Webster Apartments, as well as its grounds, parking lots, garages, public entrances, and all sidewalks adjacent to Webster Apartment's properties. All these areas are to be tobacco free and smoke free areas. The only exception to this is in the lessee’s vehicle in its assigned parking spot.


The term "smoking" means inhaling, exhaling, burning or carrying any lighted or heated cigar, cigarette, pipe, or any other lighted or heated product containing, made or derived from nicotine, tobacco, marijuana, or other plant intended for inhalation. As of August 1, 2019, this definition includes carrying or using an activated electronic delivery device.

The term "electronic cigarette" means any electronic device that provides a vapor of liquid nicotine and/or any other substances to the user as he or she simulates smoking. The term shall include such devices whether they are manufactured or referred to as e-cigarettes, e-cigars, e-pipes or under any product name.

The term “incense” means a substance that is burned to emit an odor comprised of two primary components- a fragrance and a burning agent.

Management will consider the smoking policy violated if a resident or any guest(s) of the resident is found using any smoking or tobacco related products in any restricted area.
